The Kelly Confidential Virtual Lemonade Stand Promotion begins at 12:01 a.m. Eastern Time ("ET") on June 8, 2009 and ends at 11:59 p.m. ET on September 7, 2009 ("Sweepstakes Period"). If you're not already registered with the Website, you must register first. Registration is free. Limit one (1) registration per person and per email address. When you open a virtual lemonade stand, you will automatically receive one (1) entry into the Open a Stand Sweepstakes. As part of opening a virtual lemonade stand, you may choose to upload a photo of yourself and submit a message that meets the space requirements. Uploading a photo and submitting a message is optional and doing so does not increase your chances of winning. Photos must comply with Photo Guidelines described below. ENTRY METHOD #2 - You can enter the Open a Stand Sweepstakes without opening a virtual lemonade stand by clicking here and providing your complete name, complete address, telephone number (including area code), email address and date of birth. The maximum number of entries per person, per email address and per household during the Sweepstakes Period is one (1) entry, regardless of method of entry.
Photo Guidelines: Photo must be submitted in JPG, GIF or PNG format and cannot exceed 700KB in size. Photo may only feature entrant and may not feature any third parties or third party materials. Any photo that is obscene or offensive; contains trademarks or logos owned by others, contains any personal identification; contains copyrighted materials owned by others; contains materials embodying the names, likenesses or other indicia identifying any person other than entrant; communicates messages or images inconsistent with the positive images and/or good will to which Sponsor wishes to associate; and/or violates any law will be removed and may void entry. Photo must not infringe upon the copyrights, trademarks, rights of privacy, publicity or other intellectual property or other rights of any person or entity. By submitting a photo, you hereby grant permission for the photo to be posted on www.kelly-confidential.com. You agree that that Released Parties (as defined below) are not responsible for any unauthorized use of photos by third parties. Released Parties do not guarantee the posting of any photo.
By opening a virtual lemonade stand on the Website, you agree to have your registered name or stand name and any monies raised through your virtual lemonade stand published on the Website and be made available for viewing by other Website registrants (see below for a description of how money can be raised and for what purpose). Monies raised by your virtual lemonade stand do not increase your chances of winning.
VISIT A STAND SWEEPSTAKES: During the Sweepstakes Period, there are two (2) ways to enter the Visit A Stand Sweepstakes (the "Visit A Stand Sweepstakes"). ENTRY METHOD #1 -Visit the Website and follow the instructions to select one of the options to take one of the available actions regarding your virtual lemonade stand, such as changing the color, picture, font, menu board, lemonade flavor, inviting a friend to visit your virtual lemonade stand, spreading the word to your Facebook or twitter networks or posting a badge on your blog or webpage (each, an "Action"). If you have not already set-up a virtual lemonade stand, you must set-up your stand (see item 1 above; registration and setting-up a stand are free) or use ENTRY METHOD #2 below to enter. The first time you take one Action each day, you will automatically receive one (1) entry into the Visit A Stand Sweepstakes. You can take Actions more than once each day, but you will only receive one (1) entry for the first action you take on that day. ENTRY METHOD #2 - You can enter the Visit a Stand Sweepstakes without taking part in an Action by clicking here and providing your complete name, complete address, telephone number (including area code), email address and date of birth. You can enter the Visit a Stand Sweepstakes using Entry Method #2 one (1) time each day during the Sweepstakes Period if you have not already entered using Entry Method #1. The maximum number of entries per person, per email address per household during the Sweepstakes Period is one (1) entry per day, regardless of method of entry.
Refer-a-Friend: If the Action you are taking is sending a notification to a friend through Entry Method #1 above, you will be asked to provide your email address (you must use the email address you used to register for the Website) and your friend's email address, Twitter handle or Facebook name on the Sweepstakes entry page. The referral email and/or message will include a standard message inviting your friend to donate to the Ovarian Cancer Research Fund and will include a URL link to the Website. To send the referral email and/or message, you must click on the "Send" button on the Sell Lemonade page. You will then receive one (1) entry into the Visit A Stand Sweepstakes, regardless of whether your friend visits the Website or enters the Visit A Stand Sweepstakes. If you have received an email and/or message from Sponsor letting you know that a friend has invited you to visit the Website, you are not automatically entered in the Visit A Stand Sweepstakes and must complete at least one of the entry methods above in order to enter the Visit A Stand Sweepstakes. By opening a virtual lemonade stand on the Website, you agree to have your name and any monies raised at your virtual lemonade stand published on the Website in connection with your registered name and be available for view by other Website registrants. Neither monies raised by your virtual lemonade stand nor the number of visits to the Website or your lemonade stand will have an effect on or increase your chances of winning.
Post a Badge: If the Action you are taking is posting a badge on your or your blog or web page(s), follow the directions provided to copy a badge from www.kelly-confidential.com and put it on your blog or web page(s). You will then receive one (1) entry into the Visit A Stand Sweepstakes.
DONATE TO A STAND SWEEPSTAKES: During the Sweepstakes Period, there are two (2) ways to enter the Donate to a Stand Sweepstakes (the "Donate to a Stand Sweepstakes"). ENTRY METHOD #1 - Visit a virtual lemonade stand and follow the instructions to make a donation to the Ovarian Cancer Research Fund. You must donate a minimum of $1.00. For the first $1.00 donation you make each day, you will automatically receive one (1) entry into the drawing. ENTRY METHOD #2 - You can enter the Donate to a Stand Sweepstakes without making a donation by clicking here and providing your complete name, complete address, telephone number (including area code), email address and date of birth. The maximum number of entries per person, per email address and per household during the Sweepstakes Period is one (1) entry per day, regardless of method of entry. You can enter the Donate To a Stand Sweepstakes using Entry Method #2 one (1) time each day during the Sweepstakes Period if you have not already entered using Entry Method #1. The maximum number of entries per email address per household and per method of entry during the Sweepstakes Period is one (1) entry per day. Neither the existence of a donation nor the amount of any donation, if any, will increase your chances of winning.
All entries for each Sweepstakes described above must be received by Sponsor by 11:59 p.m. ET on September 7, 2009 to be eligible. Registrations generated by script, macro or other automated or mechanical means or which attempt to subvert the entry process will be void. All entries become property of the Sponsor and will not be returned. Sponsor's computer is the official time-keeping device for this Promotion.
One (1) potential winner will be selected for each of the Sweepstakes above. A random drawing for each Sweepstakes will be made on or about September 10, 2009 from among all eligible entries received for the applicable Sweepstakes (for a total of three (3) separate random drawings for the Promotion). Odds of winning depend on the number of eligible entries received for the applicable Sweepstakes drawing. Non-winning entries from one drawing will not be included in any other drawing. The potential winner of each Sweepstakes will be notified by e-mail, telephone and/or U.S. mail and will be required to execute and return an affidavit of eligibility, a liability release and, where lawful, a publicity release within seven (7) days of date of issuance ("Eligibility and Release Forms") of notice. If such documents are not returned within the specified time period, the prize notification is returned as undeliverable, Sponsor is unable to contact a potential winner within seven (7) business days of date of initial notification or the potential winner is not in compliance with these Official Rules, prize will be forfeited and Sponsor will conduct another random drawing of all remaining eligible entries to select an alternate potential winner for the applicable Sweepstakes. Winners of one Sweepstakes are not eligible to win a prize in any other Sweepstakes.
One (1) winner for each Sweepstakes will win a new Electrolux French Door Refrigerator with Perfect Temp Drawer™ (Approximate Retail Value of Grand Prize: $3,999 each). Winners must take delivery of the Grand Prize within ninety (90) days of Sponsor's receipt of the completed Eligibility and Release Forms. Sponsor is not responsible for providing cabinetry or the installation of the appliances. Manufacturer's standard written limited warranty will apply. Sponsor shall be responsible for shipping and delivery to winner's primary residence within the forty-eight (48) contiguous United States or the District of Columbia. All taxes, including but not limited to federal, state and local taxes, and any other costs and expenses associated with prize acceptance and use not expressly provided for herein, are the sole responsibility of the winner, including any costs of installation. Winners may not substitute, assign or transfer prize or redeem prize for cash, but Sponsor reserves the right, at its sole discretion, to substitute a prize with one of comparable or greater value. Registrations and entries received from any person, email address or household in excess of the stated limits stated above for any Sweepstakes will be void. Any entrant's failure or refusal to comply with these Official Rules will result in his or her entries being void, and entrant being subject to disqualification from all applicable Sweepstakes. Released Parties are also not responsible for any incorrect or inaccurate information, whether caused by site users, tampering, hacking, or by any equipment or programming associated with or utilized in the Promotion. Released Parties are not responsible for injury or damage to participants' or to any other person's computer related to or resulting from participating in this Promotion or use of the website. Persons who tamper with or abuse any aspect of the Promotion or website or who are otherwise in violation of these Official Rules, as solely determined by Sponsor, will be disqualified and all associated entries will be void. Entrants, by participating, agree that neither the Sponsor, CMGRP, Inc. d/b/a Weber Shandwick, nor their respective parents, affiliates, subsidiaries, or advertising and promotion agencies or any of their respective officers, directors, employees, agents or representatives (collectively, "Released Parties") will have any liability whatsoever for, and each of the Released Parties shall be held harmless by entrants against, any liability, for any injuries, losses or damages of any kind, including death, to persons, or property resulting in whole or in part, directly or indirectly, from acceptance, possession, misuse, use or inability to use of the prize (including any injury or harm resulting from use of the appliance) or participation in this Promotion. Each winner, by acceptance of prize, except where legally prohibited, grants permission for Sponsor and its designees to use his/her name, address (city and state), photograph, voice and/or other likeness and prize information for advertising, trade and promotional purposes without further compensation, in all media now known or hereafter discovered, worldwide in perpetuity, without notice or review or approval. Each winner agrees that that all contact with the media, if any, regarding the Promotion and the prize awarded shall be coordinated by Sponsor, and winner shall not discuss the Promotion or the prize with any media organization without the Sponsor's consent. In the event of a dispute regarding entries received from multiple users having the same email account, the authorized subscriber of the email account at the time of entry will be deemed to be the entrant and must comply with these Official Rules. Authorized account subscriber is the natural person who is assigned the email address by the Internet Service Provider (ISP), on-line service provider, or other organization responsible for assigning email addresses.
